Terms of Export

These Terms of Export ("Terms") govern quotations, orders, and transactions between Brivex Sportswear ("Brivex," "we," "us," "our") and any business buyer ("Buyer," "you") who requests a quote or places an order through this Site or through direct communication with our export team.

2.1 Nature of Our Business

Brivex Sportswear is a business-to-business (B2B) manufacturer and exporter of custom athletic apparel, operating from our production facility in Sialkot, Pakistan. We do not sell at retail, and this Site does not process retail payments — all engagements begin with an inquiry, sampling, and a formal agreement between Brivex and the Buyer.

2.2 Quotations & Pricing

  • Any pricing, quantity estimates, or lead-time figures shared via the RFQ form, email, or WhatsApp are indicative only and do not constitute a binding offer until confirmed in a written Proforma Invoice (PI) or formal order confirmation signed or acknowledged by both parties.
  • Prices are subject to change based on final specifications, fabric selection, order quantity, destination, and prevailing raw-material costs at the time of order confirmation.
  • All quoted prices are in US Dollars (USD) unless otherwise stated in writing, and are exclusive of duties, taxes, and destination-country import charges unless explicitly stated otherwise.

2.3 Minimum Order Quantity (MOQ)

Our standard minimum order quantity is 15 pieces per style, per the capabilities listed on our Site. MOQ may vary by product category, fabric, or customization complexity, and will be confirmed at the quotation stage.

2.4 Sampling Process

  • • All bulk orders are preceded by a sampling stage, in which Buyer reviews and approves a physical sample against the agreed tech pack before bulk production begins.
  • • Standard sampling turnaround is approximately 10–14 working days from receipt of complete tech-pack information and, if applicable, sample payment.
  • • Sample costs, if any, and their treatment against bulk orders (credited or non-refundable) will be specified at the time of quotation.

2.5 Production & Lead Times

Production lead times are quoted per order based on quantity, complexity, and current factory capacity, and are estimates rather than guarantees. Brivex will communicate any anticipated delays as early as reasonably possible.

2.6 Payment Terms

Unless otherwise agreed in writing, standard payment terms are 30% advance deposit (T/T bank transfer) to confirm the order, with the remaining 70% balance payable prior to shipment against a copy of the shipping documents. Letters of Credit (L/C) may be accepted for larger orders subject to prior agreement.

2.7 Shipping, Incoterms & Delivery

  • FOB Karachi Port BasisUnless otherwise agreed, quotations are provided on an FOB (Free on Board) Karachi Port basis.
  • Import Duties & TaxesBuyer is responsible for import duties, taxes, and customs clearance in the destination country unless otherwise agreed.
  • Delivery TimelinesEstimated delivery timelines exclude customs delays, carrier delays, or force majeure events outside Brivex's control.

2.8 Compliance with Export & Import Regulations

Both parties are responsible for complying with applicable export control laws of Pakistan and import regulations of the destination country. Buyer is responsible for confirming that products ordered comply with the import requirements, labeling standards, and applicable regulations of their own country or region.

2.9 Intellectual Property

  • Any logos, designs, trademarks, or artwork provided by Buyer for customization remain the property of Buyer. By submitting such materials, Buyer confirms they have the legal right to use and reproduce them, and agrees to indemnify Brivex against any third-party IP claims arising from their use.
  • Brivex retains no rights to reproduce or resell Buyer-specific designs to any other party without Buyer's written consent.

2.10 Quality & Inspection

Buyer may request a pre-shipment inspection (self-conducted or via a third-party inspection agency) at Buyer's cost prior to shipment. Any quality disputes must be raised in writing within seven (7) days of receipt of goods, accompanied by supporting evidence (photos, etc.).

2.11 Force Majeure

Brivex shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, power outages, government action, or disruptions to shipping and logistics networks.

2.12 Limitation of Liability

To the maximum extent permitted by law, Brivex's total liability for any claim arising from an order shall not exceed the value of the affected order. Brivex is not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

2.13 Governing Law & Dispute Resolution

These Terms are governed by the laws of Pakistan. Any disputes arising from these Terms or an order shall first be attempted to be resolved amicably through good-faith negotiation; failing that, they shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.
